Batteries requirements

Producers must communicate their status as a battery producer to the Autonomous Region in which they are established. Registration with Register of Industrial Establishments also required.Registration, collection and recycling obligations for batteries producers
Producers of portable batteries
Producers can comply by participating in
- a public management system of a municipality or Autonomous Community
- a collective system
- a deposit and Return system, or
- an individual system
Producers of industrial batteries
Individual compliance is permitted. Approval must be granted for individual systems by each Autonomous Region in which it operates
Packaging requirements
Obligated parties must register and submit data based on the amount of packaging handled, to the Autonomous Regions and the local authorities in Spain.
Packers/fillers & distributors are exempt from the requirement to operate a deposit and return system or make arrangements to take back packaging themselves if they take part in an ‘integrated system' to manage packaging waste, which will ensure that the recycling and recovery targets are met on their behalf.
Thresholds
The law covers all packers and vendors of packaged products. The take-back obligation on packers and vendors is limited to the packaging of products it places on the market.
For distributors, the obligation is limited to packaging of products which they could have distributed and which are marked as such (for example, an electronics retailer would be required only to take back electronics packaging).
