Registration, collection and recycling obligations for batteries producers

Producers of portable and industrial batteries

Producers can join a collective scheme and transfer legal responsibility to the scheme. Individual compliance for portable batteries is also permitted but requires a waste plan to be submitted for approval by SenterNovem for individual systems.

Producers of industrial batteries

Producers can join a collective scheme and transfer legal responsibility to the scheme. Individual compliance is also permitted but requires a waste plan to be submitted for approval by SenterNovem for individual systems.

Packaging requirements

Producers and importers must notify the Ministry of the Environment every five years of:

1. how packaging will be taken back;
2. packaging prevention measures taken;
3. co-operation efforts with other producers and importers; and
4. take back, recovery and recycling financing.

Producers and importers must also report every three years to the Ministry of the Environment on the preceding three years take back results, including measures taken to allow take back, recovery and recycling targets to be achieved, quantities of packaging placed on the market, packaging waste generated and any shortcomings in the packaging chain.

Producers and importers may meet their recovery and recycling obligations

1. individually;
2. by becoming signatories of the Packaging Covenant; or
3. by participating in a collective recovery scheme.

Producers and importers that become signatories to the Packaging Covenant are released from their obligations regarding take back, recovery and recycling targets and reporting. The implementation of the Covenant is controlled by the SVM-PACT organization (Organization for Packaging and the Environment)

Thresholds

All producers and importers are covered by the Regulations. There are no thresholds for companies who only handle small quantities of packaging.
